2.4 We may sub-contract or assign some or all of the performance of the Service to suitably qualified third-party contractors. Our obligations to you under these Terms and Conditions remain the same where the Service is carried out by sub-contractors on our behalf.
3.1 Bookings may be made by telephone, email, online enquiry or any other method we make available from time to time. A Booking is only confirmed once we accept it and issue confirmation with the agreed date, time window and indicative price or pricing structure.
3.2 When placing a Booking, you must provide accurate and complete information about:
(a) The collection address and contact details.
(b) The type, approximate volume and weight of the Waste.
(c) Any access restrictions, parking limitations, stairs or long carrying distances.
(d) Any items that may be regulated, hazardous or difficult to handle.
3.3 We will rely on the information you provide when preparing estimates and determining vehicle and staffing requirements. If the information is incomplete or inaccurate, the actual price, time required and feasibility of the Service may vary from the initial estimate.
3.4 Booking times are given as an estimated arrival window. While we will use reasonable efforts to arrive within the agreed time window, we do not guarantee exact times and accept no liability for minor delays caused by traffic, weather, access issues or other circumstances beyond our reasonable control.
4.1 Prices for the Service are typically based on one or more of the following: volume of Waste, weight, labour time, type of materials, access conditions, and disposal or recycling charges.
4.2 Any price or quote provided before our team inspects the Waste on site is an estimate only. The final price will be confirmed once our team has assessed the actual Waste and access conditions on arrival.
4.3 If the volume, weight or nature of the Waste differs materially from the description provided at the time of Booking, we may adjust the price accordingly. We will inform you of any price change before proceeding with the Service.
4.4 If you do not agree to the revised price, you may cancel the Service at that point. However, a call-out or cancellation charge may be applied if our team has already arrived on site, as set out in the cancellation section below.
5.1 Unless otherwise agreed in writing, payment is due in full on completion of the Service and before our team leaves the site.
5.2 We accept payment methods made available by us from time to time, which may include cash, debit or credit card, bank transfer or invoicing for approved account customers.
5.3 Where we agree to provide the Service on account, payment terms will be stated on the invoice. If no specific terms are stated, payment is due within 14 days of the invoice date.
5.4 If payment is not received when due, we reserve the right to charge interest on overdue sums at the statutory rate and to recover any reasonable costs incurred in pursuing payment.
5.5 You agree that you are responsible for all charges arising from the Booking, including any additional charges for extra Waste, labour or waiting time where applicable.
6.1 You may cancel or reschedule a Booking by contacting us during our normal business hours.
6.2 If you cancel or reschedule more than 24 hours before the agreed arrival window, no cancellation fee will normally apply, unless we have specified otherwise at the time of Booking.
6.3 If you cancel or reschedule within 24 hours of the agreed arrival window, we may at our discretion charge a cancellation fee to cover administrative and scheduling costs, up to a reasonable proportion of the estimated Service price.
6.4 If our team arrives at the collection address at the agreed time and is unable to gain access, or if the Waste is not available for collection as described, we may charge a call-out fee and any waiting time beyond a reasonable initial waiting period.
6.5 We may cancel or reschedule a Booking if we are unable to provide the Service due to events beyond our reasonable control, including adverse weather, vehicle breakdown, staff illness, road closures or regulatory restrictions. In such cases, we will use reasonable efforts to notify you as soon as possible and arrange an alternative time. We will not be liable for any consequential loss arising from such cancellation or rescheduling.
7.1 You must ensure safe and reasonable access to the Waste at the collection address, including any necessary parking permissions or permits for our vehicles.
7.2 You must ensure that the Waste presented for collection is as described in the Booking and that it does not contain any prohibited, hazardous or illegal materials.
7.3 You must inform us of any known or potential health and safety risks at the premises, such as loose flooring, broken glass, sharp objects, contamination risks or structural defects.
7.4 You agree not to request that our staff carry out any work or service that is unsafe, illegal or beyond the scope of rubbish removal and waste collection.
7.5 You are responsible for securing or removing any personal or valuable items before we begin the Service. We do not accept responsibility for items that are disposed of if they were not clearly separated from the Waste.
8.1 Certain types of waste cannot be collected as part of a standard rubbish removal service, either because they are hazardous or subject to specific legal controls. Prohibited items may include, but are not limited to:
(a) Asbestos and materials containing asbestos.
(b) Clinical or medical waste, including syringes and pharmaceutical products.
(c) Pressurised gas bottles and cylinders.
(d) Explosives, ammunition or fireworks.
(e) Corrosive, flammable or toxic chemicals.
(f) Radioactive materials.
(g) Large quantities of liquids, including oils, fuels and paints, unless agreed in advance.
8.2 If you present any prohibited or restricted items without prior agreement, we may refuse to remove them and may still charge for attendance and any part of the Service carried out.
8.3 Where certain controlled items can be collected subject to special arrangements or additional charges, this will be agreed with you in advance and carried out in compliance with applicable regulations.
9.1 We operate our services in accordance with relevant UK waste management legislation and duty of care requirements. We will transport and dispose of Waste at licensed or authorised facilities, aiming where reasonably practicable to divert materials from landfill through reuse and recycling.
9.2 By using our Service, you confirm that you are the owner of the Waste or that you have full authority from the owner to arrange its removal.
9.3 Once the Waste has been loaded onto our vehicle and payment has been received, ownership of the Waste transfers to us, subject to applicable laws and any specific regulatory requirements.
9.4 We may issue a waste transfer note or similar documentation where required by law or requested by commercial customers. It is your responsibility to retain such documentation for your records and regulatory compliance.
10.1 We will exercise reasonable care and skill in providing the Service. However, to the fullest extent permitted by law, we shall not be liable for:
(a) Any loss or damage arising from inaccurate or incomplete information provided by you.
(b) Any loss of profit, business interruption, loss of anticipated savings, loss of reputation or any indirect or consequential losses.
(c) Damage to driveways, paths, manholes, underground services, lawns or other surfaces where you have requested or agreed that our vehicles or equipment may operate on or over areas not designed for such use.
10.2 If we cause damage to your property through our negligence, you must notify us as soon as reasonably practicable and in any event within 7 days of the Service being carried out. We shall have the right to inspect the damage and may arrange for repair or reasonable compensation at our discretion.
10.3 Our total liability to you for any loss or damage arising out of or in connection with the Service, whether in contract, tort (including negligence), breach of statutory duty or otherwise, shall be limited to the total price paid for the specific Booking that gave rise to the claim, except where such limitation is prohibited by law.
10.4 Nothing in these Terms and Conditions shall limit or exclude our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under applicable law.
11.1 We maintain public liability insurance and any other insurance cover required by applicable law and our operations. Details of our insurance can be provided upon reasonable request.
11.2 It remains your responsibility to maintain adequate insurance for your own property and contents, including any items that may be at risk during the collection and removal of Waste.
12.1 If you are dissatisfied with any aspect of our Service, you should contact us as soon as possible so that we can investigate and, where appropriate, seek to resolve the issue.
12.2 We may ask you to provide details of your Booking, a description of the problem and any supporting evidence. We will review your complaint and respond within a reasonable time.
13.1 We will collect and process personal information about you to manage enquiries, Bookings, payments and the performance of the Service, and to meet our legal and regulatory obligations.
13.2 We will handle your personal data in accordance with applicable data protection laws and will take reasonable steps to keep it secure. We will not sell your personal data to third parties. We may share necessary information with employees, contractors and service providers involved in delivering the Service or administering our business.
14.1 We may update or amend these Terms and Conditions from time to time to reflect changes in our services, legal requirements or business practices.
14.2 Any changes will apply to Bookings made after the updated Terms and Conditions are issued. For existing confirmed Bookings, the version in force at the time of your Booking will apply, unless you agree otherwise in writing.
15.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Service, shall be governed by and construed in accordance with the laws of England and Wales.
15.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Service provided to you.
16.1 If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or competent authority, that provision will be severed from the remaining provisions, which will continue to be valid and enforceable.
16.2 No failure or delay by us in enforcing any right or remedy under these Terms and Conditions shall constitute a waiver of that or any other right or remedy.
16.3 These Terms and Conditions constitute the entire agreement between you and us relating to the Service and supersede any prior agreements, understandings or arrangements, whether written or oral.
